Welcome to Pearl of Mind Wellness, LLC (“POMW,” “we,” “us”). By accessing our website, purchasing a membership, or using our digital resources, you agree to the following Terms of Service.

1. THE MANDATORY CLINICAL DISCLAIMER (EDUCATIONAL USE ONLY)

Please read this section carefully. All services, materials, digital resources, and content provided by Pearl of Mind Wellness, LLC, its owner Matthew Rosario, and its affiliates are for educational and informational purposes only.

  • No Therapy/Medical Advice: Nothing provided by POMW constitutes the practice of professional counseling, psychotherapy, medical advice, or mental health treatment.

  • No Provider-Patient Relationship: Your use of this site or our resources does not create a therapist-client relationship, a clinical supervision relationship, or a formal provider relationship with Pearl of Mind Wellness, LLC, Matthew Rosario personally, or any affiliates.

  • Not a Substitute for Judgment: These resources are designed as tools to support clinical work. They are not a substitute for the professional judgment, diagnosis, or treatment planning of a qualified healthcare provider.

2. PROFESSIONAL RESPONSIBILITY & SCOPE OF PRACTICE

By using our resources, you acknowledge and agree that:

  • Sole Responsibility: You are the solely responsible party for how you implement, share, or interpret POMW resources.

  • Scope of License: You agree to use these materials only within the specific scope of your professional license, education, expertise, and local jurisdiction laws.

  • Client Appropriateness: You are responsible for determining if a specific resource is clinically appropriate for a specific client at a specific time. POMW is not liable for any clinical outcomes or adverse reactions resulting from the use of these educational tools.

3. MEMBERSHIP TERMS & LICENSE TO USE

Upon purchasing a Membership, you are granted a limited, non-exclusive, non-transferable license to:

  • View and download resources for your own professional development.

  • Share individual resources with your direct, individual clients as part of an active therapeutic or educational session.

Prohibited Actions (Anti-Hoarding & IP Protection):

  • No Bulk Distribution: You may not redistribute resources to colleagues, group practices, training programs, or listservs without explicit written permission.

  • No Public Posting: You may not upload resources to public forums, social media, or public-facing websites.

  • No Resale/Rebranding: You may not sell, rebrand, or claim authorship of any POMW materials.

  • Anti-Hoarding: Systematic or bulk downloading of large portions of the library in a short timeframe is considered a violation of these terms and may result in immediate account termination without refund.

4. ACCOUNT INTEGRITY

Access is tied to the individual email used at sign-up. Sharing login credentials with third parties or colleagues is strictly prohibited. You are responsible for all activity occurring under your account.

5. CANCELLATION & REFUNDS

  • Monthly Memberships: May be canceled at any time. Due to the immediate access to digital IP, monthly fees are non-refundable.

  • Annual Memberships: May be canceled within 14 days for a prorated refund. After 14 days, annual fees are non-refundable. Refunds may be denied if substantial library downloading has occurred during the 14-day window.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pearl of Mind Wellness, LLC and Matthew Rosario shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our materials, or for any actions taken by clinicians based on the educational content provided.

7. GOVERNING LAW

These terms are governed by the laws of the State of New Jersey. Any disputes arising from these terms shall be resolved in the appropriate courts within that jurisdiction.
