Daily Pearls Terms

The short version. Daily Pearls offers reflections for everyday wellbeing. It is not therapy or medical care, and no one monitors what you write. Your purchase is one-time, with no subscription.

1. Agreement

These terms are between you and Pearl of Mind Wellness, LLC ("Pearl of Mind," "we," "us"). They add to Apple's Licensed Application End User License Agreement (the "Standard EULA"), which also applies to your use of Daily Pearls (the "App"). If they conflict, these terms control for anything between you and us, and the Standard EULA controls for anything involving Apple. You accept these terms by tapping "I agree" when you first open the App.

2. What Daily Pearls is (and isn't)

Daily Pearls offers a daily reflection prompt, a library of prompts, a Home Screen widget, an Apple Watch app, and a private space to write your own reflections. All prompts are built into the App and are the same for everyone. We update them only through App Store updates. Prompts are prepared with AI tools and research-informed. It is general wellness education. It is not therapy, counseling, diagnosis, medical care, or a crisis service, and using it doesn't create a professional relationship with Pearl of Mind or its founder. Prompts are general and are not written for your personal situation. No one at Pearl of Mind sees or monitors what you write, so the App cannot respond if you are in danger.

3. Who can use it

You must be at least 13 years old. If you are under 18, you need a parent's or guardian's permission to use the App and agree to these terms.

4. Your purchase

Daily Pearls is a one-time purchase, with no subscription. Your purchase includes the current App and any updates we release for as long as we offer Daily Pearls in the App Store. If we stop offering the App, the version on your device may keep working, but we can't guarantee it will work with future versions of iOS or future devices. Apple handles all payments and refunds under its own policies.

5. License

We give you a personal, non-transferable license to use the App on Apple devices you own or control, as the Standard EULA allows, including Family Sharing where available. The prompts, text, and design belong to Pearl of Mind. You may not copy, republish, or sell the prompts, or use them to train AI models. Your own reflections belong to you.

6. Your reflections and your device

Your reflections and saved prompts are stored on your device. Deleting the App from your iPhone (and from your Apple Watch, if it's installed there) deletes them, and we can't recover them. Backups of your device, such as iCloud Backup or a computer backup, may include App data. Apple or you control those backups; we do not. See our Daily Pearls Privacy Policy.

7. Disclaimers and limits

To the extent the law allows, the App is provided "as is." We don't guarantee any particular wellbeing result, or that the App will be error-free or always available. Sections 14 (Limitation of Liability) and 16 (New Jersey Consumer Rights) of our Terms of Service apply to your use of the App. To the extent permitted by law, our total liability to you for all claims arising out of or relating to the App is limited to the greater of the amount you paid for the App or $100. If you reside outside the United States, you retain any mandatory consumer protections that cannot be waived under the applicable laws of your country of residence.

8. Apple terms (required)

  • These terms are between you and Pearl of Mind only, not Apple. Pearl of Mind, not Apple, is responsible for the App and its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the extent the law allows, Apple has no other warranty obligation for the App.
  • Pearl of Mind, not Apple, is responsible for handling any claims about the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
  • If anyone claims that the App or your use of it infringes their intellectual property, Pearl of Mind, not Apple, is responsible for investigating and resolving that claim.
  • You confirm that you are not in a country subject to a US government embargo and not on a US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

9. Changes, law, and contact

We may update these terms. We'll show you material changes in the App before they apply. New Jersey law governs, subject to Section 7's protections for residents of other places. Disputes follow Section 19 of our Terms of Service, including the 30-day informal resolution step, New Jersey courts, and the class-action waiver. Small claims court remains available. The class-action waiver referenced in Section 19 of our Terms of Service does not apply to users under the age of 18 where such a waiver is prohibited or unenforceable under applicable state law.
